Requirements for Issuance of Marriage Licenses
Marriage Licenses are issued Monday through Friday between the hours of 8:00 a.m. and 4:45 p.m. If you plan to come in the afternoon, you should arrive no later than 4:30 p.m., as the licensing process takes about 15 minutes. You can expedite the marriage licensing process by having a completed marriage license application when you arrive. The application form is available on the web site and can be downloaded and printed by you. Please use an ink pen to complete the marriage license application form. The cost of the marriage license is $40.00. The Probate Office accepts cash, check or money order for payment. We cannot however, accept out of state checks.
The legal age to marry without parental consent in Alabama is 18 years. Persons aged 16 or 17 years old may obtain a marriage license only if both parents are present with valid identification and they consent in writing. You must also bring a state certified copy of your birth certificate.
If you are 18 years of age or older, you must bring one of the following: a drivers license, military identification, or certified copy of your birth certificate. Pre-marital blood tests are no longer required by the State of Alabama.
If you have been divorced, please note that you may not apply for a marriage license within 60 days after your divorce was granted, unless you are marrying your former spouse.
A marriage license is valid for 30 days from the date it is issued and there is no required waiting period for marriage after the license is obtained. The license is only good for marriages performed in the State of Alabama.
The Clarke County Probate Court requires appointments to be made if you wish to be married by the Probate Judge. There is an additional $15.00 fee for the marriage ceremony. Appointments can be made by calling our office for available days and times.
Copies of Marriage Records
Copies of marriage records can be obtained from our office or through the Department of Vital Statistics, either in Montgomery or through any county Health Department in Alabama. For Copies from Probate Court, you may either mail a written request for a copy with the appropriate fees or come by our office to pick up copies. You must have the names of the parties involved and the year of the marriage. Regular copies are $1.00 and court certified copies are $4.00 each for copies from the Probate Court. Please contact the individual county Health Department or Vital Statistics for their fees.
